Sütiş Membership Agreement

SÜTİŞ MEMBERSHIP AGREEMENT and TERMS OF USE OF PROGRAMME

This Sütiş Farm Mobile Application Program (hereinafter referred to as the “Programme”) of ………………………….. Joint Stock Company (hereinafter referred to as “SÜTİŞ”) has been created in order to provide its members with the advantages to be determined by Sütiş such as offering online shopping opportunities, benefiting from discounts, campaigns and promotions, and being entitled to gift vouchers. This agreement is a membership agreement signed by digital execution and acceptance method for the advantages to be offered within the scope of the Programme.

By becoming a member of the Programme and using it, you declare that you accept this Membership Agreement, Programme Terms of Use, PDPL agreement, Privacy Policy, Privacy and Security Agreements.

DEFINITIONS:

1 Joint Stock Company: It refers to all subsidiaries, parent companies, affiliates and all companies that are or may be included in the “Sütiş” group of companies, even if not directly related.

2.Credit Card Data: It refers to the data belonging to the bearer bank credit cards uploaded by the Member to MasterPass or similar certified card storage solutions.

3.Masterpass: It refers to the system that allows users to make payments by defining their card information to the system from the masterpass.com.tr address offered by Mastercard, one of the programme collaborators, or from the payment page at merchants with the MasterPass logo. Within the scope of this agreement, MasterPass refers to the system that allows you to make payments from the credit cards of your own banks by defining the credit cards of the users to the Mastercard page placed within the Application.

4.Mobile Application: It refers to the mobile application named Espressolab Mobile Application that works on mobile phones, tablets, computers and similar portable devices.

5.Programme Collaborators: It refers to all service providers, their affiliates, subsidiaries and other group companies and their employees including but not limited to Turkey Representative Office of MasterCard Europe SA. (“Mastecard”) and Akbank T.A.Ş. (“Akbank”) whom Sutiş has been working or will work with within the scope of the Programme.

6.Member: He/she is the real person who becomes a Member of the Sütiş Programme and who has logged in to the mobile application or website by registering by checking the box or boxes next to the text “I have read and accept the User Agreement” and/or similar phrase during the Membership registration to the Sütiş Farm Mobile Programme specified by the Member via the website and approving this Agreement by providing personal information in the fields in the Mobile Application or www.sutis.com.tr

9.Membership Information: All kinds of personal information that may include, but are not limited to, the Member’s name, surname, mobile phone, e-mail, T.R. Identity Number, date of birth, gender data, security question answer.

GENERAL TERMS AND CONDITIONS:

1.The ownership of Sütiş website and the Application belongs to Sütiş.

2.All services within the scope of the application are provided by Sütiş and/or its collaborators authorised by Sütiş.

3.In order to use the Sütiş Farm Programme, the application form must be filled in and approved by the Member and the necessary information (T.R. Identity Number, Name, Surname, Contact Information, Security Code, etc.) must be recorded as specified.

4.Sütiş Farm membership is personalised and cannot be transferred to anyone else. The benefits earned under the programme cannot be transferred to another member outside the programme.

7.In the event that the Member’s membership or the device on which the Application is installed is stolen, lost or damaged in such a way that it cannot be used, the Member shall immediately and without delay notify Sütiş via +90…………….. hotline . The Member accepts and declares that he/she is responsible for any damages that may occur until the notification is made. Upon the notification to be made by the Member to Sütiş, the membership shall be made inactive by Sütiş. In order for the benefits gained for the deactivated membership to be transferred to a new membership, the Member must login via www.sutis.com.tr or Sütiş Farm Mobile Application and transfer the inactive membership to the new membership. In case of non-transfer, Sütiş has no responsibility.

8.The conditions of use, advantages and duration of the Sütiş Farm membership are determined by Sütiş. Sütiş may change these terms of use at any time in order to ensure the security of the application and to comply with the legal legislation, without any prior warning and notice to the Member, and may stop, remove or cancel the use of the membership.

When the membership expires, the membership is automatically renewed and the usage period is extended. In cases where the term of membership cannot be renewed, the member may request closure of the account. The member accepts and declares that he/she will not make any right and claim regarding the rights he/she has acquired by becoming a member of Sütiş Farm.

9.The Member accepts and declares in advance that the personal information provided in the membership application form is correct, that he/she will update his/her information in case of any changes, and that Sütiş and/or Programme collaborators are not responsible for any damages that may arise as a result of not updating the information in this membership application form or providing incorrect information.

10.If you request that your personal data processed within the scope of the Application not to be processed by Sütiş, since Sütiş will no longer have the opportunity to serve you through the Application, the membership will be terminated if the relevant account information in the Application (if any) is forwarded to Sütiş on the date the processing of personal data ends.

11.This Membership Agreement does not in any way mean the transfer of the rights subject to Intellectual and Industrial Property by Sütiş, and all rights within the scope of IP Law and FSEK owned, registered or unregistered by Sütiş (all registered or unregistered intellectual property rights such as title, business name, trademark, patent, logo, design, information and method on this Site) belong to Sütiş.

12.Payments to be made through the Sütiş Farm Programme may not be approved for different reasons. In cases such as exceeding the limit, incorrect or incomplete entry of the security code, incorrect information entry, expiry of the expiry date, temporary connection problems, lost / stolen notified card, it may be possible to receive a “no provision” message from the Credit Card. In the event that such a message is received, which means that the payment confirmation has failed or has not been completed, the Member is advised to contact the relevant bank without sharing the card details with third parties. The Member accepts and declares that Sütiş shall not be liable for the non-approval of the payment for any reason, illegal card usage and the credit relationship between the Member and the bank where the Member uses the Credit Card.

13.During the implementation of the Sütiş Farm Programme, in the event that the continuation of this implementation is not possible for any reason whatsoever due to changes in the legislation in force, the Sütiş Farm Programme and its membership shall automatically become null and void.

14.The member agrees not to give his/her membership information, username, mobile phone and/or password to anyone else, not to let them use them, that he/she is responsible for their storage, that Sütiş has no responsibility in this regard, and that in case the membership is misused by third parties and/or by the member in any way, The Member accepts, declares and undertakes in advance that Sütiş has the authority to immediately cancel the membership and terminate the membership without prejudice to any other legal right, that all rights arising from the membership will be lost, that all rights and gains related to the membership will be taken back from him/her, that all kinds of measures may be applied, and that the responsibility in disputes arising / may arise from all these practices belongs entirely to the Member.

15.Sütiş reserves the right to change or modify these Terms of Use, Sütiş Farm Programme, any policies, guidelines related to the Mobile application at any time and at its sole discretion. Change or modification shall be published at  www.sutis.com.trand these changes should be checked by the Member from time to time. Specific notifications of such changes or modifications are published as updates and users are informed. Following such changes or modifications, your access, continuation or participation in the Sütiş Farm Programme, Sütiş Mobile application confirms your acceptance. If you do not accept these Terms of Use, you may terminate your membership to the Sütiş Farm Programme.

16.In case of dispute, commercial books and records of Sütiş shall constitute conclusive evidence.

17.In the implementation and interpretation of this Membership Agreement and in the management of legal relations arising within this Membership Agreement, Turkish Law shall apply, except for the Turkish conflict of laws rules in case of foreign element. Istanbul Courts and Execution Offices are authorised for the resolution of disputes.
