Cancellation and Refund Policy

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION & RETURN CONDITIONS

GENERAL:

1.When you place an order electronically through the mobile application you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

2.The Buyer is subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, as well as other applicable laws regarding the sale and delivery of the purchased product.

3.If there is no contrary provision, shipping fees which are product delivery costs must be paid by the Buyer.

4.Each purchased product shall be delivered to the person and/or organization at the address specified by the Buyer within a maximum legal period of 30 days. If the product is not delivered within this period, the Buyer may terminate the contract.

5.The purchased product must be delivered completely, in accordance with the specifications stated in the order, and with documents such as warranty certificate and user manual if available.

6.In case the sale of the purchased product becomes impossible, the Seller must notify the Buyer in writing within 3 days from the date the Seller becomes aware of this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID FOR:

7.If the Buyer does not pay the price of the purchased product or the payment is canceled in bank records, the Seller’s obligation to deliver the product shall end.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

8.After the product is delivered, if it is determined that the payment made by the Buyer’s credit card was used unlawfully by unauthorized persons, and if the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the Seller within 3 days, with shipping expenses belonging to the Seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

9.If force majeure situations occur which the Seller cannot foresee and the product cannot be delivered on time, the Buyer will be informed of the situation. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order and the payment was made in cash, the amount will be refunded within 14 days from the cancellation. If the Buyer made the payment by credit card, the refund is also made to the bank within 14 days; however, the bank may transfer it to the Buyer’s account within 2-3 weeks.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

10.The Buyer shall inspect the goods/services subject to the contract before accepting delivery; damaged or defective goods/services such as crushed, broken, or torn packaging shall not be received from the shipping company. The delivered goods/services are considered to be undamaged and intact upon delivery. If the right of withdrawal will be used, the goods/services must not be used. The invoice must be returned together with the product.

RIGHT OF WITHDRAWAL:

11.The Buyer may exercise the right of withdrawal, without assuming any legal or criminal responsibility and without giving any reason, by rejecting the goods and notifying the Seller via the contact details below within 14 (fourteen) days from the date the purchased product is delivered to the Buyer or the person/organization at the address specified.

13.If the purchased product is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the performance of the service has begun with the approval of the consumer before the withdrawal period ends.

14.The costs arising from the exercise of the right of withdrawal belong to the Seller.

15.In order to use the right of withdrawal, written notification must be provided to the Seller via registered mail, fax, or email within the 14 (fourteen) day period, and the product must not have been used within the scope of “Products for Which the Right of Withdrawal Cannot Be Used” stated in this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

16.The Buyer sends the goods back to the Seller with the contracted cargo company within 10 days from the date the right of withdrawal is exercised. Within 14 days following the notification of withdrawal, the product price is refunded to the Buyer in the same manner in which the payment was made. When returning the goods, the invoice presented to the Buyer during delivery must also be returned. (If the invoice of the product to be returned is issued on behalf of a company, the return must be sent together with the return invoice issued by the company. Returns of orders invoiced to companies cannot be completed if a RETURN INVOICE is not issued.)

If the Buyer sends the goods with the contracted cargo company specified in the preliminary information form, the return shipping cost belongs to the Seller. If there is no branch of the contracted cargo company in the Buyer’s location, the Buyer may send it with any cargo company, and in this case, the return shipping cost belongs to the Seller. If the Buyer sends the product with a cargo company other than the contracted one, the return shipping cost and any damage during shipping belongs to the Buyer.

17.If a decrease in the value of the goods occurs due to the fault of the Buyer, or if returning it becomes impossible, the Buyer is obliged to compensate the Seller’s damages proportionally to the Buyer’s fault. However, the Buyer is not responsible for changes and deterioration caused by the proper use of the goods/product within the withdrawal period.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

18.Products prepared in line with the Buyer’s request or clearly in accordance with personal needs, single-use products, items at risk of spoilage or with the possibility of expiration, products whose packaging is opened by the Buyer after delivery and which are not suitable for return due to health and hygiene reasons, products that are mixed with other items after delivery and cannot be separated due to their nature cannot be returned in accordance with the Regulation. Also, the right of withdrawal cannot be exercised for services whose performance has begun before the end of the withdrawal period with the approval of the consumer, as per the Regulation.

DEFAULT AND ITS LEGAL CONSEQUENCES

20.If the Buyer falls into default in the case of payment by credit card, the Buyer accepts, declares, and undertakes that he/she will pay interest within the framework of the credit card agreement signed between the cardholder bank and the Buyer, and will be responsible to the bank. In this case, the relevant bank may take legal action; claim expenses and attorney fees from the Buyer and in any case, if the Buyer falls into default due to debt, the Buyer accepts to pay the damages and losses suffered by the Seller due to the late performance of the debt.

PAYMENT AND DELIVERY

21.You can make payment via Bank Transfer or EFT (Electronic Funds Transfer) to any of our bank accounts (TL).

22.Through our mobile application, you can use your credit cards and benefit from both online single payment or online installment options. For your online payments, the amount will be charged from your credit card at the end of your order.
